DARI KOLONIAL KE NASIONAL: ARAH KEBIJAKAN KRIMINAL DALAM KUHP BARU INDONESIA

Artikel ini menelaah arah kebijakan kriminal dalam Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana sebagai fase transisi dari hukum pidana kolonial menuju kodifikasi nasional. Perdebatan pembaruan kerap mengutamakan asal-usul teks, seakan penggantian Wetboek van Strafrecht otomatis memutus rasionalitas punitif kolonial. Penelitian menggunakan metode hukum normatif dengan pendekatan konseptual dan historis-kritis. Hasil analisis mengarah pada dua temuan: nasionalisasi lebih dekat pada reposisi otoritas daripada pembatasan daya paksa pidana, serta perluasan kriminalisasi berbasis moralitas memperbesar ruang diskresi penegakan, sehingga kodifikasi nasional bergerak sebagai perangkat tata kelola sosial yang terus membentuk konfigurasi kontrol punitif.
