HONOR KILLING DI ASIA SELATAN: KONSTRUKSI DAN RESPONS HUKUM PIDANA DI PAKISTAN, INDIA, DAN NEPAL

Penelitian ini bertujuan untuk mengkaji bagaimana konstruksi honor killing di Asia Selatan, bagaimana pola, pemicu, dan bentuk honor killing, lalu bagaimana respons hukum honor killing. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan perbandingan hukum pidana terbatas pada Pakistan, India, dan Nepal. Hasil penelitian memperlihatkan bahwa honor killing tumbuh dari konstruksi kehormatan sebagai reputasi kolektif yang dilekatkan pada tubuh dan relasi perempuan, lalu dipertahankan melalui kontrol keluarga atas perkawinan, seksualitas, dan batas sosial. Pola pembunuhannya dipicu terutama oleh perkawinan pilihan sendiri, penolakan perjodohan, relasi antarkasta atau antaragama, dan penolakan terhadap otoritas keluarga. Respons hukum di tiga negara memperlihatkan kecenderungan yang sama, yaitu pembunuhan sudah dilarang secara formal, tetapi penegakan hukumnya menghadapi hambatan serius dari impunitas sosial, pemaafan keluarga, dan pembiaran komunitas.
